A Staten Island man who was recently charged in a rape from 13 years ago may walk free on a technicality involving the statute of limitations in rape cases.

Lerio Guerrero allegedly attacked his victim, then 28, outside her Lower East Side apartment in November of 2008, "threatened her with a piece of broken glass, raped and sodomized her, then took her wallet."
